According to the Bank’s website, the project consists of the provision of a senior loan of up to EUR 14 million to SC Apa Prod SA, the provider of water supply and wastewater collection and treatment services in the County of Hunedoara in Romania. The proceeds of the loan will co-finance, alongside EU Cohesion Funds, the Company's investment programme for the rehabilitation and expansion of the water and wastewater infrastructure in the County of Hunedoara.
The Project will enable SC Apa Prod to expand its operations and achieve compliance with EU directives on drinking water quality and wastewater collection and treatment.
High-medium risk due to potential sensitivities for land acquisition and land use related to the expansion of the water and wastewater networks.
The E&S due diligence found that key E&S risks and potential impacts from the Project relate to the Client's organisational and operational health and safety ("OHS") capacity, along with its ability to extend these to its contractors. In addition, some of the construction works will take place inside or in the proximity of Natura 2000 sites (namely, Strei - Hateg, Padurea Bejan, Muntii Metaliferi, Magurile Baitei, Defileul Muresului, Defileul Muresului Inferior - Dealurile Lipovei, Raul Mures, and Branisca Ilia).
Furthermore, as the planned works include extension of pipe networks, there is potential of encountering unknown structures and other items of cultural heritage value.
There will not be any involuntary resettlement of formal settlements or expropriation / acquisition of private land related to Project activities. However, temporary access to private agricultural and other types of land may be required.

ACCOUNTABILITY MECHANISM OF EBRD
The Project Complaint Mechanism (PCM) is the independent complaint mechanism and fact-finding body for people who have been or are likely to be adversely affected by an European Bank for Reconstruction and Development (EBRD)-financed project. If you submit a complaint to the PCM, it may assess compliance with EBRD's own policies and procedures to prevent harm to the environment or communities or it may assist you in resolving the problem that led to the complaint through a dialogue with those implementing the project. Additionally, the PCM has the authority to recommend a project be suspended in the event that harm is imminent.
